US Judge Mandates Freedom of Abrego Garcia from Immigration Detention

A court has ruled the immediate release of Kilmar Abrego Garcia from detention by ICE, finding his continued detainment lacks legal authority.

"Since Abrego Garcia's return from erroneous imprisonment in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis stated in her ruling.

The case stems from a mistaken deportation to El Salvador earlier this year, which US authorities later acknowledged was an error. Following his repatriation to the United States to face alien smuggling charges, he was detained in federal detention.

In her decision, the judge noted that the government does not have a current removal order, which prevents them from deporting Mr. Abrego Garcia "for now."

Background of the Legal Challenge

The court challenge involve conflicting claims. While the Trump administration contends that Abrego Garcia is a member of the MS-13 gang, he vehemently disputes this allegation.

He has also pleaded not guilty to the smuggling charges, which are part of a separate trial in Tennessee.

The court, who was hearing his challenge to removal in a federal court, ruled that he must now adhere to the conditions of his bond from custody in Tennessee. This order shifts his monitoring to the Tennessee court.
